Greater Phoenix Chamber Applauds Arizona Courts for Approving Court Rule Change on Third Party Litigation Financing set to take effect January 2026

The Greater Phoenix Chamber proudly extends its sincere gratitude to the Arizona Courts for the decisive approval of the court rule change regarding third party litigation financing, a decision that will take effect in January 2026. This forward-thinking measure promises to foster greater transparency, accessibility, and fairness in Arizona’s legal system, reinforcing the state’s commitment to innovation and justice. 

Leadership and Vision Recognized

We especially wish to thank former Chief Justice Robert Brutinel for his foresight in recognizing the necessity to address the evolving landscape of litigation financing and for Chief Justice Timmer for calling on the courts to examine this vital issue.

We are grateful to the Arizona Courts for their foresight and dedication to improving the legal landscape for all Arizonans.” 

The Chamber led the rule change effort on this important regulatory reform issue on behalf of the business community in early 2024 by submitting proposed rule modifications to the Arizona Courts Alternative Business Structure (ABS) Committee. The court’s ABS Task Force work over the course of several months was crucial in the final adoption of the court’s changes. Our Chamber is deeply grateful for the pivotal contributions of Justice Clint Bolick, whose oversight into the Alternative Business Structure Task Force was instrumental in shaping the court’s approach to this rule change. Justice Bolick guided the courts through this period of study, collaboration, and reform. His commitment to open dialogue and careful consideration ensured all voices were heard throughout the process. 

The Greater Phoenix Chamber’s director of public affairs, Mackenzie Shane was appointed to the ABS Task Force along with Page Faulk of the U.S. Chamber who worked with a broad range of Arizona business stakeholders.  

“This legal reform for the Arizona court system was thoughtfully formulated within the business community to ensure third-party litigation funding (TPLF) in the court system has proper and transparent disclosures in place,” says Mackenzie Shane.

This rule change marks a significant step forward for Arizona’s legal and business environment. By providing guidance and oversight for third party litigation financing, the courts have enhanced opportunities for businesses and individuals to seek justice, while protecting the integrity of legal proceedings.
